- Besides exceptional conditions clearly mentioned on the order or invoice and signed and accepted by the customer, the only applicable general sales conditions are described hereunder.
- The price offers are based upon the actual fees of labour, materials and services. If changes of costs occur, BALLEO S.L. has the right to adjust the prices accordingly, by automatically voiding any previous outstanding offers.
- The delivery time is only mentioned as a indication and are in no way binding. Any eventual delay in the delivery time will not create any form of compensation nor will it void the order agreement.
- Any possible complaints with regard to the delivery of goods and/or services have to reach us within 8 days of final delivery and in any case before the use or resale of the products.
- Any protest or complaints regarding our invoices have to be made by registered mail within 8 days of the issue date of the invoice. Customers need to clearly mention the number and issuing date of the concerned invoice.
- All our invoices have to be paid is cash, unless otherwise agreed upon.
- In case of non-payment of the invoice within the agreed period, a yearly interest fee of 12% is applicable from the issue date of the invoice, this without any additional writing. At the same time BALLEO S.L. will apply a flat compensation fee equal to 10% of the order, with a minimum of €250,00.
- In case of cancellation of the order, the buyer has to pay a flat compensation fee equal to 25% of the order, with a minimum of € 500,00 not excluding any demand of higher compensation or damages.
- As long as the delivered goods or products are not completely paid for, they will remain property of BALLEO S.L..
- BALLEO S.L. remains at all times sole owner of all graphic work, images, Virtual Tours and all other digital material it produces including the resulting Intellectual property rights.
- In case of dispute between the customer and BALLEO S.L., only the courts located at the headquarters of the company are entitled to handle the case.
- Any orders accepted by our personnel are only binding after a written order confirmation by BALLEO S.L. duly signed by one of the General Managers.
- If the customer doesn’t accept the product or services or the communicated day of delivery, BALLEO S.L. has the right – after a period of 15 days – to consider the order as void and this without any additional writing or form of compensation to the customer. The storage of the products will be on the cost and under the responsibility of the customer awaiting the delivery.
- In case of ‘force majeure’, strike, lockout, severe weather conditions, etc. the execution of the order is not possible, BALLEO S.L. remains the right to cancel the order without any compensation for the customer.
- BALLEO S.L. remains the right to cancel the order without any additional writing in case of change in the legal situation, financial difficulties, termination of the activities of the customer or in case of non-payment of outstanding invoices.
- Any costs created by non-covered cheques or by any other financial issues are not included in previous compensations and will have to be paid separately by the customer.
- When ordering any development or other services the customer has to pay 50% of the order amount at the moment of signature, 30% on delivery of the draft design and the remaining 20% no later than 30 days after signature of the order. When ordering Domain Names, web site Hosting, or printed advertisements the customer has to pay 100% at the moment of signature.
- In case of non-payment, BALLEO S.L. has the right to immediately cancel all services and/or developments.
- In case of non-payment or if the customer doesn’t provide BALLEO S.L. on time with the necessary materials or information (photographs, text, graphic material, etc.) BALLEO S.L. has the right to cancel the order without any additional writing, be it for the entire order or part of it.
- The customer has the obligation to provide BALLEO S.L. within a period of 30 days after signature all the necessary information (photographs, text, graphic material, etc.) for the normal execution of the ordered products or services. In the other case BALLEO S.L. will invoice the customer the complete order even if the ordered services or products are (were) not delivered.
